By accessing or using The $5 Club platform, you acknowledge that you have read, understood, and agree to comply with these Terms of Service. These terms constitute a binding legal agreement between you and The $5 Club. If you do not agree to any part of these terms, you must immediately discontinue using our services. Your continued use of the platform signifies your acceptance of these terms, including any updates or modifications made to them in the future.

2. Eligibility

To use The $5 Club services, you must meet the following criteria:

• You must be at least 18 years of age. By using our services, you confirm that you meet this age requirement.
• You must have the legal capacity to enter into a binding agreement under the laws of your jurisdiction.
• You must not be prohibited from using our services under applicable laws or regulations. By accessing the platform, you represent and warrant that you meet these eligibility requirements. If at any point you are found to be ineligible, your membership may be suspended or terminated.

3. Membership

Membership with The $5 Club is subject to the following terms:

• Membership Fee: To join, you must pay a one-time admin fee of $5 via Cash App. Additionally, a one-time payment of $5 is required to be sent to your referrer. These payments are non-refundable.
• Benefits of Membership:
  • Access to exclusive members-only content, resources, and offers.
  • Participation in community features, such as forums, discussions, and networking opportunities.
  • Eligibility for referral-based benefits as outlined in our program guidelines.
• Membership Cancellation:
  • You may cancel your membership at any time through your account settings.
  • Upon cancellation, you will lose access to all member-exclusive features and content.
  • No refunds will be issued for payments already made.

4. User Responsibilities

As a member of The $5 Club, you agree to the following responsibilities:

• Account Security: You are solely responsible for maintaining the confidentiality of your account information, including your username and password. Sharing your account credentials with others is strictly prohibited.
• Notification of Unauthorized Access: You agree to notify us immediately if you suspect any unauthorized access to or use of your account. Failure to do so may result in the suspension or termination of your account.
• Compliance with Laws: You agree to comply with all applicable laws and regulations while using our services. Any illegal activity or misuse of our platform may result in immediate termination of your membership.

5. Termination

We reserve the right to terminate or suspend your membership at our sole discretion, without prior notice, for any of the following reasons:

• Violation of Terms: If you breach any part of these Terms of Service.
• Harmful Conduct: Engaging in behavior that we determine to be harmful, abusive, or disruptive to other members or The $5 Club as a whole.
• Fraudulent Activity: Providing false information, engaging in fraudulent transactions, or attempting to manipulate the system in any way.

Upon termination, you will lose access to all membership privileges, and no refunds will be issued for any payments made.

6. Content Ownership

All content provided through The $5 Club, including but not limited to text, images, videos, graphics, software, and other materials, is the property of The $5 Club or its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use this content for personal, non-commercial purposes only. You agree not to:

• Copy, reproduce, distribute, or publicly display any content without our prior written consent.
• Modify or create derivative works based on our content.
• Use any content for commercial purposes or in a manner that infringes on our intellectual property rights.

7. Limitation of Liability

To the fullest extent permitted by law, The $5 Club and its affiliates, officers, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform or services.
• Loss of data, revenue, profits, or business opportunities resulting from your use of or inability to use our services.
• Any unauthorized access to or alteration of your account or data.

While we strive to provide a secure and reliable platform, you acknowledge that The $5 Club is provided "as is" and "as available," and we make no warranties regarding the accuracy, reliability, or availability of our services.

8. Changes to Terms

We reserve the right to update or modify these Terms of Service at any time. Any significant changes will be communicated to you through email or a notification on the platform. It is your responsibility to review the updated terms periodically. Continued use of our services after changes have been made constitutes your acceptance of the new terms. If you do not agree to the revised terms, you must discontinue using the platform immediately.

These Terms of Service and any disputes arising from your use of The $5 Club shall be governed by and construed in accordance with the laws of The Commonwealth of Virginia, USA, without regard to its conflict of law principles. Any legal actions or proceedings related to these terms shall be brought exclusively in the courts located in The Commonwealth of Virginia, USA.
